These Terms of Service (“Terms”) govern your access to and use of ypnus.com and the YPN USA platform (the “Service”), operated by YPN INC (“YPN USA,” “we,” “us”). By using the Service, you agree to these Terms.
1. What YPN USA Is — and Is Not
YPN USA is a software and marketing platform for mortgage loan officers. We are not a mortgage lender, mortgage broker, or financial, legal, or tax advisor, and we do not originate, underwrite, or fund loans. We provide tools to help you market your own services.
2. Eligibility
You must be at least 18 and authorized to use the Service for your business. You are responsible for maintaining any licenses your profession requires.
3. Accounts
You agree to provide accurate information and to keep your credentials secure. You are responsible for activity under your account.
4. Subscriptions, Billing, and Auto-Renewal
Paid plans are billed in advance on a recurring monthly basis through our payment provider, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Plan prices are shown at checkout, and we may change prices with reasonable notice.
5. Free Trial
Paid plans include a 14-day free trial. If you do not cancel before the trial ends, your subscription automatically converts to a paid plan and your payment method is charged. A valid payment method is required to start a trial.
6. Cancellation and Refunds
You may cancel at any time through your customer portal or by emailing support@ypnus.com. See our Cancellation Policy and Refund Policy.
7. No Guarantee of Results
We provide marketing tools; we do not guarantee any specific number of leads, search rankings, income, or loan volume. Results depend on many factors outside our control and vary by user.
8. Your Compliance Responsibility
You are solely responsible for ensuring your use of the Service complies with all applicable laws and regulations, including (where applicable) NMLS/SAFE Act licensing, RESPA, TILA, ECOA/fair lending, TCPA, and CAN-SPAM. You are responsible for including all required disclosures (such as your NMLS ID, Equal Housing Opportunity, and licensing information) on your sites and communications.
9. Acceptable Use
You agree not to use the Service for any unlawful, deceptive, abusive, or infringing purpose, not to send unlawful messages, and not to interfere with or reverse-engineer the Service.
10. Intellectual Property
We own the Service and its underlying technology. You retain ownership of the content you provide and grant us a license to host and display it to operate the Service.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind to the fullest extent permitted by law.
12. Limitation of Liability
To the fullest extent permitted by law, YPN USA will not be liable for indirect, incidental, special, or consequential damages, and our total liability will not exceed the amounts you paid us in the 12 months before the claim.
13. Indemnification
You agree to indemnify YPN USA against claims arising from your use of the Service or your violation of these Terms or applicable law.
14. Termination
We may suspend or terminate access for violation of these Terms. You may stop using the Service at any time.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
16. Changes
We may update these Terms and will post the revised version with a new effective date.
